Acceptance of Terms:

Your utilization of Web Cube Solutions’ services is contingent upon the following terms and conditions. Please carefully read and understand our terms and conditions as well as our privacy policy. By using the Web Cube Solutions website, you are considered to have agreed to and accepted our terms and conditions and privacy policy.

Web Cube Solutions retains the exclusive right to modify these Terms & Conditions and Privacy Policy at any time. It is your responsibility to periodically check for any changes in our terms. Using this website after any alterations to the Terms & Conditions implies your acceptance of those changes. We are not responsible for whether or not you review them. If you choose not to accept and comply with these Terms & Conditions at any time, please refrain from using this website.

Service Terms:

The Agreement’s terms begin on the date you, the Client, enroll for our services and continue until terminated by either party in accordance with the Terms and SLA.

Web Cube Solutions has the authority to employ its identifying marks, which may include logos, designs, URLs, or other forms of brand identity, on all websites created by us, without requiring the consent of our customers or clients.

Description of Service:

Web Cube Solutions may provide you, the Client, with one or more services, including but not limited to Website Design & Development, associated products/services, Internet Marketing, Mobile Application Development, Content Development, and/or Maintenance and Support Services. Unless explicitly stated otherwise, any new feature that enhances or supplements the Services is considered part of the Services. Web Cube Solutions reserves the right to modify, suspend, or discontinue the Services (or any part thereof) at any time without notice, due to non-cooperation, non-payment, or undue delays from the client. You, the Client, expressly agree not to hold Web Cube Solutions or its suppliers responsible for any losses, damages, or consequences resulting from such modifications, suspensions, or discontinuations of the Services.

Access to Information:

In order to access Web Cube Solutions’ Services or Web Cube Solutions Websites, you may be required to provide specific registration details or other information. By accepting these terms & conditions, you acknowledge that all information provided by you will be accurate, current, and complete. If Web Cube Solutions believes the information you have provided is incorrect, outdated, or incomplete, we reserve the right to deny you access to any Web Cube Solutions Websites or Services or any of our resources, and to suspend or terminate your account at any time.

For training and quality purposes, calls may be recorded.

Changes to the Website:

Web Cube Solutions hereby declares that we have the exclusive right to change or remove the website, either temporarily or permanently, or any part of it, at any time, without prior notice. Web Cube Solutions shall not be liable to anyone (whether a Client, third-party vendor, or user) for any such changes or removal.

Database, E-Commerce & Application Development:

Web Cube Solutions is not responsible for any losses resulting from any software created for you, the Client. While we take every precaution to ensure the accuracy and error-free nature of our products, the ultimate responsibility lies with you, the Client, to ensure that all products and software function correctly before use.

When sites and applications are developed on servers not provided by Web Cube Solutions, you, the Client, are responsible for providing and/or seeking any necessary information, support, additional software, and/or cooperation related to the server required for proper application development. For the development of large applications, you, the Client, are responsible for providing a suitable testing environment identical to your final production environment.

For any application or programming related to a website developed by Web Cube Solutions, you, the Client, are expected to conduct comprehensive testing before making it available for general use. While Web Cube Solutions will make every effort to correct errors, “bugs,” or other issues found on the website developed by us after it is live, such corrections are not obligatory and will be made at our discretion to meet the site’s functional standards outlined in the brief.

Hosting & Maintenance:

For websites created and hosted by Web Cube Solutions, which include initial complimentary hosting, you, the Client, must host the website with Web Cube Solutions for a minimum lock-in period of 3 years. If you decide to obtain Cpanel details or host the website elsewhere, a small handling fee of USD 250 must be paid to Web Cube Solutions.

For websites not created by Web Cube Solutions and clients only availing hosting services, all Cpanel details will be provided only after payment of the current hosting cycle and a service/handling fee of $135 USD.

Website Design:

Web Cube Solutions will make every effort to ensure that the website’s design and any other work we perform is error-free. However, we cannot accept responsibility for any losses incurred due to website malfunctions. Until you, the Client, have paid all outstanding accounts in full, Web Cube Solutions will be the rightful owner of the web server, website, graphics, content, and any programming code. Any work performed by Web Cube Solutions will remain our property and copyright unless otherwise agreed and may only be resold or commercially reproduced with our permission.

Web Cube Solutions will not be liable for any copyright infringements resulting from materials submitted by you, the Client.

Any additions to the project scope that Web Cube Solutions makes at no charge will be at our sole discretion. For such additions, we do not assume any responsibility to ensure they are error-free. We reserve the right to charge you, the Client, accordingly for any corrections or further additions.

Web Cube Solutions will not be responsible for any loss of earnings, compensation, or costs incurred due to any work performed by you, the Client, on your behalf or by any third-party agents appointed by you, the Client.

We are not liable for loss of earnings, compensation, or costs incurred due to the unavailability of the website, servers, software, or other materials provided by our agents.

Copyright:

Web Cube Solutions owns or has the appropriate license or legal permission to use trademarks, copyrights, and intellectual property rights associated with the site and its content, including but not limited to website design, graphics, text, source codes, and all software connected with the website.

By using this website, you agree to access the content only for your personal, non-commercial use at home. You may not download, copy, transmit, reproduce, store, distribute, or sell the content without the prior written consent of Web Cube Solutions.

Disclaimers and Limitation of Liability:

Web Cube Solutions provides its website on an “AS AVAILABLE” and “AS IS” basis. To the extent permitted by law, Web Cube Solutions is not responsible for any direct, indirect consequential damage or loss (including but not limited to loss of business, data, opportunity, and/or profit) resulting from the use of the website.

Web Cube Solutions does not warrant that the website’s functionality will be error-free or uninterrupted, that defects will be rectified, and/or that the website or server making it available are free of any virus or other harmful elements.

Cancellation & Refund Policy:

All amounts owed by you, the Client, to Web Cube Solutions for Services rendered before the verified cancellation date must be paid in full. We do not prorate for partial months throughout the Agreement. Due to account security and privacy concerns, all billing-related questions and cancellation requests MUST be made in writing or via email.

Cancellation requests will only be processed if made by the initial authorizing party and if received in writing. There will be no refunds of any funds for cancellation requests made after the 3-day cooling-off period from the date of order. For security and training purposes, all calls, inbound and outbound, made through Web Cube Solutions corporate offices are digitally recorded, forming part of the verbal contract between Web Cube Solutions and the Client.

Any cancellations made by you, the Client, after the cooling-off period, for any reason, will result in full payment of the agreed price and immediate contract termination, unless mutually agreed otherwise between Web Cube Solutions and the Client.

Payment:

You, the Client, agree to pay Web Cube Solutions the service fee for any Program or Service you enroll in, as per the terms of the Payment Plan you selected, including all applicable taxes, if any, following the billing terms in effect when the service fee becomes payable. You expressly understand, acknowledge, and authorize Web Cube Solutions to automatically charge your credit card or debit your bank account once a month or as required by the Program.

You will be charged as soon as you sign up over the phone. Web Cube Solutions also reserves the right to pursue alternative means of payment, including debt collection services, and you shall be liable for all collection costs, including attorneys’ fees.

Payment Collection:

As Web Cube Solutions provides a bill-through service for sponsored listings, we assume a significant credit risk for each Client. Therefore, you, the Client, are responsible for maintaining an active and valid payment method on file at all times. If, for any reason, your payment method is unavailable, Web Cube Solutions reserves the right to immediately and temporarily suspend services, including your website, pay-per-click ads, sponsored listings, and any ongoing production, reporting, or support services until your account is paid in full. Terminating the Agreement will result in an escalation of all fees owed under the Terms of the Agreement. Many clients keep multiple forms of payment on file to prevent this from happening.

Representations and Warranties:

You, the Client, represent, warrant, and affirm that (i) you have the necessary authority to enter into this Agreement; (ii) you are conducting business, not as a consumer, and your use of Web Cube Solutions services is solely for lawful commercial and business purposes; (iii) you have the required rights to provide all information under the Agreement for the purposes described in the Agreement.
